RULES AGAINST U.S.—Judge Akio Date (above) ruled in Tokyo that the presence of American troops in Japan violated the country's U.S.-fostered "no war" constitution. In dismissing charges against seven leftist rioters, Judge Date said the U.S.-Japanese Treaty is unconstitutional.

NEW YORK (UPI) — A former strike breaker testified Monday before an investigating committee of the state Labor Department that he continued to supply typographers for struck newspapers after he became a $1,500 a week labor consultant in the newspaper publishing industry.
The witness, Lawrence Brawn, 49, said that as many as 70 percent of the men he supplied for composing rooms of strikebound papers were members of the International Typographical Union who were not adverse to making a "fast buck." He said publishers paid him $1,500 a week plus expenses and a $100 to $500 bonus for every man supplied.
Brawn was the first witness before the special committee set up last December to investigate organizations engaged in furnishing out of state workers "to disrupt the orderly process of labor-management relations." The federal Byrnes Act makes it a federal offense to import workers from another state to interfere with peaceful picketing by force or violence.
Tetis Of Training
Brawn said he received his training in this labor field from Herbert W. Flagg, Philadelphia, who operated an office known as the "H. W. Flagg Open Shop Division of the American Newspaper Publishers Association." He said he first worked as one of Flagg's "300 scabs" and later became Flaggs assistant in the work of keeping struck newspapers in operation.
The witness said Flagg dropped out of the business in 1938 or 1939 after the Byrnes Act was passed. Brawn said he took over the operation and opened an office as a "labor counselor" in Boston, using his connections with representatives of the American Newspaper Publishers Association which he had made as Flagg's assistant.
Brawn said he continued his counselling activities, which included supplying composing room workers to many struck newspapers, for a number of years in partnership with Bloor Schleppey, a lawyer. Brawn said he became labor consultant to the California Publishers Association in 1946 and 1947 and Schleppey took over the consultation business.
Paid Guarantees
Brawn said George N. Dale, Chicago, chairman of the special standing committee of the American Newspaper Publishers Association, was one of his best sources of information on labor situa-

Mercury Mining
SACRAMENTO (UPI) Mercury production continues as the relatively bright spot in the California metal mining picture according to the State Division of Mines.
During a recent visit to the New Almaden mines near San Jose, the division noted that mining of surface soil and serpentine bedrock underlying the sites of old brick furnaces for the recovery of the liquid metal has been extremely profitable.
Assumed Name
HOLLYWOOD (UPI) — The old-time children's favorite, "Pollyanna," is coming to the screen but under a new name. Walt Disney will call his movie version of the book, "The Glad Game."
