Former Hitler Youth Now a U.S. Marine Sergeant; Dream of 11 Years Realized
EL TORO MARINE AIR STATION — A dream conceived in 1940, at the age of 14, finally came true in 1953 for Marine Sergeant Ernest G. Schoening, stationed here. However, only after serving as a Hitler Youth, seeing duty as a Midshipman aboard a German submarine in the Baltic Sea and being captured eight days before the end of World War II, on the Czechoslovakian Frontier was the dream made possible.
Schoening, born October 31, 1926, in Pommerania, Germany, was one of the true Hitler Youths, but it was not of his own choosing. His father at the time was a German government official and had to make his and the remaining 30 were captured by American forces just eight days before the end of the war.

Supreme Court Of Superior Court Rules

SANTA ANA, (OCNS) — City's Superior Courts have consolidated State Supreme Court rules.
The top tribunal overturned against Cahan when it deemed microphones had been stalled in the defendant's place without his knowledge by Los Angeles police. Conversation traveled over wires to a nearby garage where they were recorded.
This method of rounding up evidence was adverse to fourth constitutional amendment, the high court held. The amendment concludes that "the right of the people to secure in their persons, houses, papers and effects, against reasonable searches and seizures shall not be violated. Norants shall issue but upon probable cause, supported by oath or affirmation. They must particularly describe the place be searched and the persons things to be seized."
Finding Poses Problems
Superior Court Judge Robert Gardner ran head on into Cahan finding this week. He confronted by a marijuana pession suspect Victor Georzogalb of Los Angeles, based his defense on the claim he had been the victim of lawful search and seizure.
And Judge Gardner went along with a portion of claims. The judge ruled a body containing particles of marijuana found in Zogaib's car reasonably obtained evidence.
San Clemente police in investigating a traffic accident for Zogaib injured and his car damaged. They saw that Zogaib was ambushed to the point of death.
Schoening, born October 31, 1926, in Pommerania, Germany, was one of the true Hitler Youths, but it was not of his own choosing. His father at the time was a German government official and had to make his son join one of the Hitler Youth movements in order to hold his job. Schoening was only ten years old at the time.
It was only by a quirk of fate that he wasn't born in the United States. In 1922 his grandfather's brother, who was already in this country, sent two tickets to his grandfather for passage to this country. One of the tickets was meant for Schoening's father, but his grandfather chose to send two of his other sons in the hope that someday Schoening's father could follow them, but the opportunity never arose and so Schoening was born a German.
When questioned regarding the Youth movement, he compared it to the Boy Scouts of America only with more of a military background. He also stated, "it would have been good training if it had not been backed by war mongers."
Assigned to Submarine
After his primary training in the Youth movement, he went to the Naval Academy at Mervik, Germany, which is near the Danish border. He was later assigned to a submarine as a navigation midshipman and spent six months in the Baltic Sea. While there, his sub was attacked by British planes and also by a Russian ship. He said that he believes his sub damaged the ship.
Before his midshipman days were over and in 1945 when Germany was getting desperate, Schoening was among 3000 men that were taken from the academy to serve with the infantry in Czechoslovakia. Because of their lack of infantry training all but 30 were killed in action and the remaining 30 were captured by American forces just eight days before the end of the war.

When he was released he rejoined his mother and sister in the British Sector of Germany and later went to work for the British Government as an interpreter.
Father Still Missing
He hasn't seen his father since the early part of the war. His father was called into the army and was declared missing in action at Mohillew, which is south of Smolensk, Russia. He said, "My father is still listed as missing in action because Russia is believed to be still holding some Germans as prisoners."
In 1951 his dream of 11 years came partially true. His great uncle, Louis Schoening of Roseglen, N.D., sponsored his coming to this country and the dream was completed when he received his citizenship papers in December, 1953. He had enlisted in the Marine Corps in July, 1952, while awaiting his naturalization papers.
Since coming into the Marines, he has attended navigation school at Marine Corps Air Station, Cherry Point, N.C., and is now a first navigator in Marine Transport Squadron 352, Marine Air Group 25, at the Marine Corps Air Station here.
He compares the Marine Corps with Germany's elite SS Troops. He says however, that the Marine Corps will always succeed where the SS Troops failed, because they serve a democratic government.
Three Ambitions
The Sergeant, a Korean War veteran, has three ambitions. He wants to bring his mother and sister to this country from Germany. Second, he wants to attend either UCLA or the University of Minnesota when his tour of duty is over, and third, he wants to continue his service with the Marines by joining a reserve organization and the hopes someday to receive a Marine commission.

San Clemente police in investigating a traffic accident for Zogailb injured and his car dugged. They saw that Zogailb ambulanced to the hospital then proceeded to remove Zogailb's vehicle from the highway. In the process of securing Zogailb's auto they tumbled on the narcotic-containing bottle.
On his arrest, Zogailb handed over several items from pockets. The judge held that all right, too, since it was a ny arrest.
Took Dim View
But Judge Gardner took a view of the officers' going the garage where Zogailb's was impounded and using a vacuum cleaner to scour the cotsions, picking up marijuana seeds.
Judge Gardner cautioned that prosecution this kind of procedure should carry a search warrant. He pointed out the court were available for the issuance of the proper warrant.
At the jail Zogailb freereturned over his clothing to jailers. Later portions of the cotsions were found in the pockets. These had a strong bear on his conviction, according to the judge.
Judge Gardner observed that Zogailb didn't have to give these his clothing unless they produced a warrant. His right would have been violated if he been refused permission to give the clothing to his attorney.
Legality Argued
Prosecutor Dewitte Chatton had a comeback on the pounded car. He contended that vehicle was impounded and that it was lawful to go ahead search it.
The judge, however, argued that this would only be a way to sidestep the law.
Gardner admitted in an interview-cuff chat the interpretation by the Supreme Court in the han case is going to make touch on Sheriff's Narcotic Chief Clint Wright and others in the same end of the enforcement game.

Supreme Court Overthrows County Superior Court Ruling on Cahan Case

NANTA ANA, (OCNS) — For the first time Orange County Superior Courts have come up against the highly controverial Supreme Court ruling in the Charles H. Cahan case. The top tribunal overthrew a bookmaking conviction at Cahan when it deemed recorded evidence against Cahan obtained unlawfully.
Phones had been in the defendant’s place but his knowledge by Los Angeles police. Conversations ended over wires to a nearby where they were recorded.
The method of rounding up justice was adverse to the constitutional amendments held. Amendment concludes that right of the people to be in their persons, houses, and effects, against unstable searches and seizures not be violated. No warshall issue but upon probation because, supported by oath confirmation. They must parly describe the place to searched and the persons or to be seized.

Miss Barnes has been the honoree recently at various showers. One was held in Alhambra by her college friends, and her matron of honor elect, Phyllis Ryan, had a shower for her.
