LEGAL NOTICE ORDINANCE NO. 901 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX, CHAPTER 1 OF THE ANAHEIM MUNICIPAL CODE BY ADDING NEW SECTIONS THERETO NUMBERED 9100.10 to 9100.12 INCLUSIVE. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1 That Article IX, Chapter 1 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto new sections to be numbered 9100.10, 9100.11 and 9100.12. Section 9100.10 WHEREAS the City Council does find and determine that by reason of the rapid growth and expansion of the City of Anaheim and the intensive development of residential areas, there is a need for additional playgrounds and park facilities to provide safe places for children to play; that the greatly increased traffic upon the highways and streets has increased the hazard to children; and that public safety and welfare require that said children be kept off the streets and highways and be provided with playground facilities and safe places for recreational purposes; and WHEREAS the City Council finds that many new subdivisions are being added to the City of Anaheim and rapidly developed, and homes erected thereto without adequate or any provisions for parks, playgrounds, or recreational facilities; that this lack of parks, playgrounds or recreational facilities causes children to play in the streets and exposes them to the danger of injury from traffic, and creates a condition that is highly detrimental to the public safety and welfare; and WHEREAS the City Council finds that a reasonable charge per lot to be assessed against each lot in subdivisions and paid to the City and used by the City for the establishment of such parks, playgrounds and recreational facilities in such areas of the City as would best accomplish such purposes would be the best means of promoting the public health and safety; and WHEREAS the City Council does find and determine that the sum of $25.00 per lot is a reasonable charge to be levied and assessed. Section $100.11 A charge of $25.00 per lot is hereby levied and assessed against each lot in such subdivision within the City or hereafter annexed to the City for which a final map has not been approved by the City Council on Before March 1, 1954, and that said sum per lot shall be paid by the subdivider and/or owner of the property subdivided upon final approval of the map of said subdivision. Section $100.12 That all funds so levied, assessed and collected by the City shall be deposited in a special fund to be known and designated as a special fund for the acquisition of parks, playgrounds and recreational facilities, and that said funds so levied and collected shall be used for each purpose in such places and in such manner as shall be approved, ordered and directed by the City Council. SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
