TUESDAY, MARCH 3, 1925 REFUSES TO QUIT ASSEMBLY POST SACRAMENTO, March 3.—Disclosing an attempt by a delegation of legislators to induce him to resign his position in the legislature, because of his alleged part in the asserted Chinese herb extortion plot, Charles Wilkinson, sergeant-at-arms in the assembly, announced today that he had refused to quit his post and had told the committee that "I have done nothing to cause me to resign." Wilkinson, according to the testimony of Fong Wan, Oakland Herbalist, offered Assemblyman Edward J. Smith, author of the herb bill, $500 to let the measure die. The legislative investigation into the herb bill scandal today was scheduled to center around the testimony of former Assemblyman William Brackett of Oakland, who is accused by the Chinese herb doctors of having conducted negotiations in the extortion plot. Brackett failed to appear at the opening of the hearing yesterday. Testimony of Y. L. Chan, Lee Shuck and Dr. Fong Wan, Bay district herbalists, brought direct charges that former Assemblyman Brackett solicited bribes to kill the bill, starting with demands for $10,000, and finally dropping to $4500. Brackett, according to Fong Wan's testimony, asked for $5000 on one occasion, outlining the proposed division of the money as follows: Two thousand five hundred dollars to Assemblyman Smith, who would split it with J. E. Hood, pharmacy board attorney; $1000 to Sen. Edgar S. Hurley; $1000 to himself (Brackett); $500 for expense. Governor Richardson's name was brought into the hearing when Y. L. Chan, Chinese import- Brackett, according to Fong Wan's testimony, asked for $5000 on one occasion, outlining the proposed division of the money as follows: Two thousand five hundred dollars to Assemblyman Smith, who would split it with J. Chan, Chinese importer, testified. Chan said he told Brackett that they did not want to do "that kind of business" and that the bill probably would not pass any way. "But Brackett said the bill would be passed," asserted Chan, "because he said, Mr. Smith was a good friend of the administration and if the bill came to the governor he would sign it." INQUIRY DELAYED IN ALLEGED PLOT SAN PRANCISCO, March 3.—Following a five-hour session of the grand jury last night, extending beyond midnight, further action by that body in the alleged attempt to kill Mr. and Mrs. Frederick Hotaling, prominent in San Francisco business and social circles, and part heirs of A. P. Hotaling, millionaire brewer, was postponed today for one week to enable police to secure corroboration of testimony given at the preliminary hearing. Among those examined last night were Richard M. Hotaling, brother of Frederick; Ralph King, declared by the police to have revealed details of the alleged conspiracy, and Lou Madison and Al Reels, alleged to have received payment to carry out the asserted plot. Richard Hotaling termed as "absurd and ridiculous" insinuations that he was in any way involved in the supposed conspiracy and demanded "vindication," insisting that the matter be sifted until his name was cleared. Detectives related how King had made his alleged confession to them that he had been requested to hire gunmen to kill Mr. and Mrs. Frederick Hotaling. Madison and Reels admitted they had received $3500 from King for the plot, but told the grand jury they never intended to kill anyone but merely were going to take King's money and decamp. Johnson has introduced senate bill No. 5 at Sacramento providing for an appropriation of $10,000 to be used in connection with the federal appropriation for the establishment of an experiment station. GERMAN PRESIDENT ELECTED MARCH 29 BERLIN, March 3. Germany will choose a successor to President Ebert March 29, the reichstag decided today. Germany prepared today to bid a dignified farewell to her first president at the formal funeral ceremonies here tomorrow. The streets thru which the cortege will pass were decorated with fir wreaths draped in black. Half a dozen 50-foot flag poles flying the republican colors have been erected in front of the station from which the body will be taken to Heidelberg.
