LEGAL NOTICE ORDINANCE NUMBER 69 AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION IN THE CITY OF ANAHEIM ON TUESDAY, THE 3rd DAY OF FEBRUARY, 1925. WHEREAS, the Clerk has submitted to the Board of Trustees of the City of Anaheim a Recall Petition demanding the election of a successor to E. H. Mitchell, a successor to E. H. Mitchell, and A. A. Slaback, the persons sought to be removed from office by said Recall Petition; and WHEREAS, said Recall Petitions were filed with the Clerk of said Board, and were found by said Clerk to be signed by qualified electors of said City equal in number to more than twenty-five (25) members of the city council vote cast within said City for approval by the district for the offices occupied by the incumbents sought to be removed at the last preceding regular municipal election at which such offices were voted for; and WHEREAS, said Recall Petitions contained a statement of the grounds on which the removal or recall is sought, and had attached to each separate paper consisting of said Recall Petition affidavit by a qualified elector of said City and sworn to before an officer competent to administer oath stating that the affiant circulated that particular paper and saw appended the signatures thereto; and that according to the best information and belief of the affiant each in the genuine signature of the form is subscribed, and of a qualified elector of said City; and WHEREAS, within ten (10) days of the date of filing said Petitions the Clerk examined, and from the records of registration asserted that Petitions were signed by the regulate number of qualified electors whereupon he attached to this Municipal Election that a result of said examination he found said Petitions to be sufficient. NOW THEREFORE, the Board of Trustees of the City of Anaheim do ordain as follows: SECTION I. A spectral election is hereby called and ordered to be held in the City of Anaheim, No phone 151. Hasson be recalled from the office of member of the Board of Trustees of said City, short term, Godfrey J. Stock be recalled from the office of member of the Board of Trustees of said City, long term. Said special election shall be held and conducted and the votes therein received and vested in the result thereof are determined and declared according to the laws of the State of California providing for and governing the recall of elective officers of incorporated cities and towns, and the poll for said election shall be and therefore open during its quiescence by said laws. SECTION 2. Nominations for said offices under recall election shall be made by petition in the manner prescribed by Section 115 of the Political Code. SECTION 3. The ballots to be used at said special election shall be such as may be required by law to be returned and in addition be any other matter required to be printed thereon by law shall appear thereon the following questions: "Shall R. H. Metcalf be recalled from the office of member of the Board of Trustees of the City of Anaheim, long term?" "Shall Dena W. Hasson be recalled from the office of member of the Board of Trustees of the City of Anaheim, short term?" "Shall Godfrey J. Stock be recalled from the office of member of the Board of Trustees of the City of Anaheim, long term?" "What should be done with blank space at separate right of each, in which the voter shall indicate by stamping a cross (X) his vote for or against said recall? On such ballots, under each such question, there shall also be printed descriptions of those who have been nominated as candidates to succeed the person recalled, in case he shall be removed from office by said recall election; but no vote shall be counted for any candidate for such office unless the voter also voted on such question of the recall to person sought to be recalled from said office. A recall (X) stamped in the blank space at the right of the word "Yes" shall be counted as a vote for and in favor of the recall of said official; and a cross (X) in the blank space at the right of the word "No" shall be counted as a vote against such recall. SECTION 1. Sample ballots containing the matter required to be printed on the official ballots, also a card stating the location of the precinct polling place of each elector, shall be supplied to the electors of said City by the City Clerk and the failure on the part of the precinct polling place to receive such sample ballot or such notice, shall not be held to invalidity or affect the station in any manner. In addition to the matter required to be printed on the official ballots, upon the sample ballot there shall be printed in not more than two hundred (200) words to reason set forth in the Recall petition for demanding the recall or said official, and upon the same balance more than two hundred (200) words, the officials may justify their course in office. It is majority of those voting on such question of the recall of any incumbent from office shall vote "NO", said incumbent shall continue in said office; a majority shall vote "YES", said incumbent shall thereupon be deemed removed from said office upon the qualification of his successor. SECTION 4. For the purpose of such special election the twelve voting presidents heretofore created and established by the Board of Supervisors of the County of Orange as the election products for the said City of Anaheim and adopted by order of said Board of Supervisors together with the territory announced to said City of Anaheim is a special election held on the 29th day of July, 1924, designated as "Industrial Site Addition," and described as follows: Beginning at the point of intersection of the center lines of Pett Street and La Porte Street as shown on a map of the Greenwell Subdivision recorded in Book 6.
