H. Cox on a charge of murder in the first degree. He appeared without counsel and was held without bail for preliminary hearing 10 a.m., June 12. Following the reported confession of Ira Noble, 40, of La Habra, that he killed G. B. Rutherford full blooded Osage Indian of Oklahoma and wealthy oil man, authorities redoubled their efforts to find Jack Rose, said to have been a witness to the slaying, which occurred during an argument over a debt. Rutherford's body was found two days ago in an auto which had been left in front of the La Habra police station. In his written confession to the authorities Noble said the slayer followed a quarry over a debt of $16. What sheriff investigators termed "death walk mystery" shared interest today with the hunt for Rose who is believed can clear up parts of the "confessional" declared to have been made yesterday by Noble following arrest at home of his son-law in La Habra, Dewey Chamblain. Noble, in admitting he stabbed Rutherford, denied he knew what happened to the body. He was under the impression it seemed that Ruthferord took a "dead walk" to his small coupe and then drove it to the city jail where the body was found propped up in the car. There was little blood in the auto. Ed McClellan, chief criminal deputy, however expressed doubt of Noble's version of the uncanny details and announced he was following another line of investigation; details of which he did not disclose. The arrest at La Habra came after Night Watchman Ed Brown had questioned Chamberlain as to the whorebouts of Ed Noble. The prisoner was to be arraign-ed late today before Judge J. B. Cox on a murder charge, the degree of which was not specified. The document was sworn to by Thelmia Rutherford of Orange bride of the Indian. The lands are located in western Oregon and include about 1,000,000 acres with approximately 20,000,000 feet of timber; to be hold at public auction. The right of purchase will be limited to citizens of the United States. RESTORE GIFT TAX WASHINGTON, May 8.—Senator Walsh, Dem. of Mass., this afternoon introduced an amendment restoring the gift tax to the tax bill. The senate finance committee had previously eliminated it. Walsh's gift tax schedule would start at $2 per cent on $25,000 and range upward to $36 per cent on $5,000,000 and over. Gifts from husbands to wives of less than $50,000 were exempted, and to children $25,000 or less. The house passed a gift-tax of from one per cent on $25,000 to 40 per cent over $10,ooo.oOOO. BANDITS HAUL OFF FOUR-TON SAFE HARRISON, Mich., May 8.—Sheriff’s and citizen’s posses are searching throuout the country for the band of men who early today broke into the state savings bank, carted a four ton safe out to a waiting automobile and succeeded in escaping without detection. The safe contained about 6ooo in cash and several thousand dollars in liberty bonds. EUGENE, May 9.—Three litterant bands armed with rifles and in a high powered car sweoped down upon Eugene late Wednesday night and after compelling L.M Miller of Elmira,F.M Pyle and Claude Waggoner of this city to climb in rushed them to the outskiirts of the city and robbed them of small amounts. A report at midnight said the robbers were believed to have crossed the Harrisburg Ferry. SWING Give up Hope of Staying Execution for Murder Three Years Ago AMITE CITY, La., May 8.-The six Italians doomed to die tomorrow for slaying Dallas Calmes at Independence, La., three years ago today sat in death cells in the county prison, resigned to their fate. Some time after high noon tomorrow the sextet will be hanged, two at a time. Only a few feet from their cells carpenters were busily engaged in making final arrangements for the execution. Two of the Italians spent the last few hours of their lives in games of solitaire, while the remaining were occupied in conversations. "Pretty cool for this time of year," one of them remarked. Another replied dully in the affirmative. Roy Leona, one of the men who attempted to save the lives of his comrades by confessing to the sole blame, sat nursing knife wounds inflicted in an attempt suicide by stabbing. Outcast by his comrades, he had little to say. They branded him as a "traitor—one who was afraid to die as a man." It was exactly three years ago today that the crime was committed. Six men plotted to rob a small bank at Independence. After driving to that little city they were "looking over the situation" when a man living near was awakened. He cried for the men to halt. An pistol battle ensued. Dallas Calmes dropped dead. Shortly afterward the Italiants were arrested, tried, convicted and sentenced to死。An appeal was made; another and still another.The case finally went over to the supreme court of the United States but so no avail. With 6,023 precincts in the state tabulated the totals stood: Coolidge 294,791; Johnson 243,- or a lead of 51,375. Most of the precincts yet to be heard from are small mountain areas which only a few votes were cast. They will not materially change the final figures it believed. The total this afternoon included 1,751 precincts from Los Angeles where the vote stood: Ridge 120,598; Johnson 61,771. WASHINGTON, May 9.—a revolt of hurricane proportions was breeding in Congress today over the age-old question of Japanese exclusion-an issue that a week ago was considered settled. The remarkable about-face of the conference committee of the Senate and House agreeing on extension until March 1, 1925, before exclusion becomes effective, has kicked up a tempest that threatens serious complications before it blows itself out. The conference committee agreed to the extension with reluctance and only at the express demand of President Coolidge andSecretary Of State Hughes. It was reported that Mr.Hughes made the matter personal issue and it was at his insistence that the president himself wrotethe amendment whichthe conference finally agreedto submit to their respective houses. The exclusion advocates ledby Pacific Coast members,were seethingwith indignation todand threatening to givethe WhiteHouse and state departmenta sharp rebuke by promptly rejectingthe amendment writteninMr.Coolidge's own hand writing.
