In the belief that the jury is already overtired with the long-drawn-out proceedings, the comedian's attorneys plan to present his case in as short a period as possible. Several witnesses were scheduled to be called today to tell of occasions on which they observed Virginia Rappe, with responsibility for whose death Arbuckle is charged, tear her clothing in apparent paroxysms of pain. Milton Carlson, who described himself as the originator of the theory—he preferred the term fact—that fingerprints may be forged, was on the stand to controvert the state's fingerprint evidence as court opened. He testified that he found no pronounced peculiarities in the fingerprint impressions on the door of room 1219 of the hotel suit.
