DENY BURCH PLOT TO ESCAPE DEATH
LOS ANGELES, Jan. 12.—In refusal of the charge that the insanity defense of Arthur C. Burch, on trial for the murder of J. Belton Kennedy, was "resorted to as a means of dodging the death penalty," Paul W. Schenck, chief counsel for Burch, declared today in his final argument to the jury that the prosecution had failed to prove that Burch committed the slaying.
Schenck pointed out that the defense, as stated at the opening of the trial, was that Burch did not kill Kennedy, but that if he did he was insane at the time. He asserted that the prosecution had failed to show that Burch was guilty of murder and that, consequently, the insanity defense was secondary to the straight claim that Burch was innocent.
With his associate counsel, J. J. Sullivan, Schenck made the final impassioned plea for Burch's life. Sullivan completed his address an hour after the trial was resumed this morning.
A strong defense of Madalynne Obenchain, co-defendant in the case, was voiced by Burch's lawyers in their attack on the prosecution's theory that Burch killed Kennedy because Kennedy refused to marry her.
His eyes blinking behind his big spectacles, two bright red spots showing in his cheeks, Burch sat unmoved as the last words were spoken in his behalf.
Mrs. Obenchain was defended by Sullivan when he declared her love for Kennedy was steadfast until the end and that her passionate letters to the man who was slain and all her actions disproved the prosecution's claim that her love changed to a murderous hate.

TO PAY ITS SHARE
Declaring that the Associated C of C has no right whatever, moral or otherwise, to assess or expend funds of the affiliated organizations in any way, directors of the Santa Ana C. of C have refused to accept the assessment of $240 levied by the Associated Chambers in payment of the bill for an investigation of the office of County Engineer McBride made approximately a year ago.
The directors assert that in supporting the investigation the Associated Chambers exceeded its authority and violated the objects of its organization.
In making this announcement, the directors issued the following statement:
"The Associated Chambers of Commerce of Orange-co is not an investigating body but was organized for and now is an organization for the promotion of harmonious and amicable relations in all sections of Orange-co. Realizing, however, that members and citizens might view this matter in a different light it was decided to arrange for subscriptions toward this fund so that any person or persons desiring to may contribute them the Santa Angle C. of C. in any amount he deems fit. Any such money received will be forwarded to the Anahejm C. of C. as that organization has assumed the obligation of paying the investigators."
A number of bodies affiliated with the county organization have paid the assessments against them, made on a basis of 300 a member.

$9900 DAMAGE SUIT TRIED ON JAN. 24TH
The $9,900 damage suit brought by A. W. McPherson against Anna Cook Arnold and J. Clem Arnold, originally set for today in the court of Superior Judge R. Y. Williams, has been postponed to Jan. 24 at 10 a.m.
McPherson claims this sum due because of alleged damages sustained by his trees and crops on 20 acres of land situated at La Habra adjoining property owned by the Arnolds.
He assigns this damage to accumulation of water from the Arnolds' property caused by alleged inadequate and insufficient system of irrigation ditches and pipelines. The water thus impounded, he claims drained across his premises, causing his land to depreciate in value, in addition to damaging his trees and crops.
His bill of damages lists 75 trees as a total loss; these he charges up at the rate of $50 each, for a total of $3,750; 50 trees partially damaged he charges at $25 each, or a total of $1,250; depreciation of land because of soured soil, $3,000; on account of falling cover crops and washing away of fertilizer $1,000; loss of crops, $1,000.
The answer filed by the defendants denies that they had an inadequate system of ditches and pipelines. They claim that they use no more water than is needed to irrigate their citrus orchard, the water being supplied to them by the La Habra Water Co.
