Monday, March 28, 1921 Cypress News Items OFFRESS, March 28—(Special)—Were received from the Jack Dugan family will moved last week to their new home in Long Beach that they had spent a most enjoyable day on Sunday attending a family reunion which was held at the Harry Krot home in Long Beach. Place cards and other decorations were in keeping with the Easter season and a pleasant time spent in visiting. Those who enjoyed the occasion were Mr. and Mrs. N. Krats and Miss Irene Krots and Miss Wally Walter of Buena Park, the Harry Krot family, Mr. Hall, Mr. Willard Swanberger of Imperial Valley, Miss Snyder and Miss Rushaw of San Francisco and the Duane family. Mr. and Mrs. Dugan had the pleasure of setting up host and hostess to a number of friends and new neighbors in their Long Beach home Saturday evening. The guests arrived as a surprise to Mr. and Mrs. Dugan but were powerlessless very welcome. A delightful evening was spent in visiting with music. Refreshments were served. About 20 guests were present. Mr. Tom Morels has gone to Los Angeles to help care for her sister, Mrs. Efigler, who has been seriously ill suffering from an attack of appendicitis. Mrs. Efigler is steadily improving. BARLEY DEAL CASE - IN COURT MONDAY Supervisor, Howard A. Wassum and D. P. King, his business partner, are plaintiffs in a civil suit., against the Globe Grain and Milling Co., which was being tried today before Superior Judge Williams. King and Wassum ask judgment against the defendants for $4390.65 with interest thereon at the rate of 7 per cent to cover losses alleged to have been sustained in a barley transaction with the Globe company. According to the complaint, the agreement with the defendants May 15, 1920, whereby the milling company agreed to buy between 7,000 and 8,000 sacks of barley at a fixed price of $3 per hundredweight. It was stipulated, according to the complaint, that the barley was to be delivered to the El Toro warehouse at El Toro. King and Wassum allege that they delivered 2,918 sacks of barley as per the agreement and received in payment $9,429.97. Further consignments, they claim, were rejected by the defendant. Part of the rejected barley, it is asserted, was record at the market price, but by this transaction they claim that they lost under the purchase price of the defendants $4313. Demurrage on railroad cars and warehouse charges are figured at $82.65, making the total loss, as claimed by the plaintiffs, $4,396.68. Alvarado Street Los Angeles CLAIMS DECEPTION IN OIL LAND DEAL Alleging that she was deceived and defrauded in a real estate transaction, Miss Mary E. Stewart, of Los Angeles, has offered suit against Ray Walker, Mr. and Mrs. W. Frank Linder, of Huntington Beach, and the Petroleum-Midway IQ Rescind an agreement whereby she was to sell to Ray Walker a lot at Huntington Beach for the sum of $700. Miss Stewart also asks $1000 damages for alleged false assertion of ownership of the property on the part of Walker and Linder and a quit claim deed to the land in question. Miss Stewart alleges that she entered into an agreement with Ray Walker in Los Angeles, Oct. 19; whereby she was to sell him the lot and that Walker gave her $50 at that time to make the deal binding. This agreement, she says, was recorded in the office of the county recorder without her knowledge. To bear out her contention that she was deceived and misled in making the agreement of sale, Miss Stewart asserts that Walker told her that he desired to acquire the property for the sole purpose of raising corn thereon. She says Walker told her that he and a farmer friend of his from Kansas desired to acquire as many vacant lots as possible in Huntington Beach for the purpose of going into the business of raising corn. The plaintiff further asserts that on Nov. 1, Walker sold the lot to Frank Linder for the sum of $10, subject to the terms of the agreement as drawn up between Miss Stewart and Ray Walker. She also claims that on Nov. 24, a community lease was entered into by certain persons among them the defendants, Walker and Linder, as lessors, and the defendant Petroleum-Midway as lessee, whereby the property at Huntington Beach including the lot which she agreed to sell Walker, was leased to the oil company for the purposes of drilling for diesel. Y. M. C. A. BOYS WILL CAMP IN VACATION Hot for the mountains. Spring vacation will be marked by special activity on the part of the members of the Orange-co Young Men's Christian Assn. The permanent mountain camp in Santiago canyon, a mile above Modjeska's home, will be in use most of the vacation week. The younger boys, led by Y. M. C. A. secretaries, will have the camp for the greater part of the time. Other plans for the week include a "Gypsy hike," over the open road to the beach and to the mountains. This hike will be led by a Y. M. C. A. secretary and no boy under 16 years of age will be taken. The boys will leave Fourth and Sycamore-st., Santa Ana, at 1 p.m. Monday, April 4. The necessary articles are two blankets and easily portable personal equipment. Food, transportation and other incidentals that may arise will be included under a total cost of $5. The boys will return April 9, giving them from Monday to Saturday on the road. Plans for the other section of the week's work, the camp in Santiago canyon, are more elaborate. The camp consists of a big cabin with a fire place, screened kitchen and dining room and four floored tents with spring mattress beds. The accommodations will permit 35 boys to occupy the camp. This camp is for boys under 16 years of age. Hikes, swimming first aid, camp craft and Bible study will be features of the program. Plenty of blankets, personal articles and a Bible are the equipment needed. Transportation will be arranged by group leaders. The cost of the camp will be $3 for three days. Registration fees must be in by April 1. The daily program is strenuous, starting at 6:15 a.m., so follows: 6:15—Revelille. Setting up exercise. 6:40—Morning watch. Quiet hour. 7:30—Breakfast. The plaintiff further asserts that on Nov. 1, Walker sold the lot to Frank Linder for the sum of $10, subject to the terms of the agreement as drawn up between Miss Stewart and Ray Walker. She also claims that on Nov. 25, a community lease was entered into by certain persons among them the defendants, Walker and Linder as lessors, and the defendant Petroleum-Midway as lesesers whereby the property at Huntington Beach including the lot which she agreed to sell Walker, was leased to the oil company for the purpose of drilling for and developing oil and other minerals thereon. Miss Stewart claims that on March 7, she discovered that Linder had entered into a lease of the property and that Walker and Linder knew that the development of oil contiguous to the property had greatly increased the value of the lot. Miss Stewart now places a value on the property that is in excess of $2500. She assert that had she known that oil companies or individuals were prospecting for oil in the immediate vicinity of her lot, she would not have entered into an agreement to sell it. In the foregoing hope of rescinding the agreement Miss Stewart asserts that she met the defendants, Walker and Linder at Huntington Beach, Dec. 20 last, and offered Walker the $60 which he had given as an initial payment on the lot. She also offered each notice in writing that the agreement was rescinded, she says. According to Miss Stewart, the two men would not accept the notices nor would Walker accept the return of the money which he had paid on the lot. GETS "PRESENT" OF 30 DAYS UPON 18TH BIRTHDAY Instead of receiving 18 slips on the back and a birthday present or two, E. V. Gardner, youthful itinerant, today, stood sentenced to a term of 30 days in the county jail by Justice of the Peace Cox after Gardner pleaded guilty to a charge of vagrancy. Gardner is of the opinion that fate dealt him a cruel blow in looking him up on his birthday. But Gardener did not go to jail alone. He has a companion, C. C. Harret, also 18, who will serve 20 days for the same offense with which Gardner is charged. Officers arrested the two youths while they were wandering about the Santa Fe railroad yards.
