THROWS OUT LAND REGISTRY PETITION
A petition for the resignation of 15 places of property in the Yorba Linda section under the state land registry act, known as the Torrena act, has been thrown out of court by Judge West for the reason that in preparing the petition the attorneys, a Los Angeles firm, had failed to observe one of the first requirements laid down in the statute. The petitioners had not sworn to their petition.
The law says that the petition must be verified by the petitioners. Evidently the attorneys took it for granted that the petition could be signed by them as attorneys, as is done in many civil procedures. However, the law is very exact and explicit in its outline of what shall be done county, and throut all of the petition the lands described were described as being in Los Angeles county.
That, of course, was an error, but descriptions of land have to be down to an exact description, if the county is to keep out of title troubles.
The judge then saw that the petitioners ha doot sworn to the petition. Without proceeding further he dismissed the action, and the Los Angeles attorneys and the 15 property owners they represent are back at the place they were before the petition was filed.
FINE POINT OF LAW
There is a fine point of law involved in the charge brought against W. P. Snyder of Sunset Beach, accused of issuing a no-fund check to the Smeltzer Home Telephone Co. Snyder's preliminary examination on the felony charge has been set for March 5.
The courts held that a no-fund check that is issued in payment of a bill for goods or services secured in the past is not a no-fund check that constitutes a felony. The law holds that to constitute a feliony the person receiving the check must be defrauded of something. When a ann gives a check for a bill that he owes, if that check is bad, the ann receiving the check is no worse off that he was before the check was issued. Therefore he is not defrauded of anything by reason of the issuance of the check.
It is alleged that Snyder gave a no-fund check in payment of a telephone bill. In this case the prosecution later day. The sentinel animously in favor and very little oppose The money will be the channel to the expenditure dredging has been "Silver Gate" is making the result of The channel has most to the East N pavilion and the m between Newport has made a wonderful appearance of the Bay front.

Bookkeeper for the hall and confined to a Los Angeles firm, had failed to observe one of the first requirements laid down in the statute. The petitioners had not sworn to their petition.
The law says that the petition must be verified by the petitioners. Evidently the attorneys took it for granted that the petition could be signed by them as attorneys, as is done in many civil procedures. However, the law is very exact and explicit in its outline of what shall be done in order to place land under the registry system. Under that system the county becomes responsible for the transfers of registered land. Courts in this county have heretofore demanded an exact compliance with the procedure laid down by law.
Miles I. McCarty, who is the first named petitioner, and the others interested in the case, appeared in Judge West's court to complete the registration. The attorneys confidently expected immediate judgment. Judge West, however, began a review of the papers submitted in the case. The first thing that he noticed was out of the way and which wouldn't be allowed to go into the records for registration was that the attorneys had used a printed form for petitions to be filed in Los Angeles

The money will be used in extending the channel to the jetty.
The expenditure of the $50,000 for dredging has been completed and the "Silver Gate" is now idle and awaiting the result of the bond election.
The channel has been completed almost to the East Newport boat house pavilion and the result of the filling between Newport and East Newport has made a wonderful change in the appearance of the property along the Bay front.
