LEGION POST HAS LOST ITS CHARTER; WHIPPING EDITOR
SECTION 1. Notice is hereby given that on the 28th day of April, 1921, the Board of Trustees of the City of Anaheim passed and adopted its resolution of Intention No. 148, entitled: "A Resolution of the Board of Trustees of the City of Anaheim declaring its intention to order the widening of the south side of Chestnut street in the City of Anaheim from the west property line of South Los Angeles street to the easterly property line of South Lemon street in said City," declaring the intention of said Board of Trustees to order the following described street work to be done in said city, to-wit:
That the south side of Chestnut street in said City, from the west property line of South Los Angeles street to the easterly property line of South Lemon街 be widened to a uniform width of 24.75 feet southerly from parallel to the center line of said Chestnut street.
SECTION 2. That the land deemed necessary to be taken for said work and improvement is situated within the said City of Anaheim and is described as follows, to-wit:
Beginning at the northwesterly corner of building lot forty-four (44) of the Town of Anaheim as shown on a map recorded in Book 4 of Decds at Pages 629 and 630 Records of Los Angeles county, California; thence easterly along the northerly line of said building lot forty-four (44) and along the northerly line of building lots forty-three (43), forty-two (42), and forty-one (41) as shown on said map five hundred fifty-two (552) feet more or less to the present westerly line of South Los Angeles street; thence southerly along present westerly line of South Los Angeles street ten (10) feet; thence westerly parallel to the northerly line of said building lots forty-one (41), forty-two (42), forty-three (43) and forty-four (44), five hundred and fifty-two (552) feet more or less to the westerly line of said building lot forty-four (44); thence northerly along said westerly line ten (10) feet to the place of beginning.

LEGION POST HAS LOST ITS CHARTER; WHIPPING EDITOR
LOS ANGELES, May 25—Following investigation which he conducted yesterday, Byron Fitts, state commissioner of the American Legion, revoked the charter of Russell Howland Post No. 62, American Legion of Carpinteria, because six members of the post administered fifty lashes to Arthur M. Clark editor of the Carpinteria Herald and former well known Los Angeles newspaper man.
The hergewhipping of Mr. Clar occurred Monday night in the Legion hall and five of the principal who figured in it were later fine $100 each in justice court. They declared that they took things into their own hands because Mr. Clark had published in his paper certain statements which were offensive to the American Legion.
Following his investigation yesterday, Commander Fitts stated that while Post No. 62 had taken no official action in regard to the editorial statements printed by Mr. Clark, I felt called upon to revoke the post charter. He declared that he will ask the state executive committee uphold his action.
Discussing the matter from this other angle, he stated that he to the editor he didn't think animosively toward one man was sufficient justifi- for an attack upon the American Legion.
The Carpinteria post is the first American Legion organization in this state to lose its charter. About men were members of it.
Mr. Clark is an overseas veteran The Legion men took exception to the editorial tone of his paper.
Commander Fitts, assisted by Carl A. Soper of the executive committee and of the Santa Barbara post, co-directed the hearing, summoned members of Carpinteria post and had to edit before them.
"I feel safe in saying," the co-munder said, "that none of the members of the Carpinteria post who part in this display of lawless violence will ever again be admitted membership in the Legion. I say the same thing of Mr. Clark."

Excepting therefrom the land hereinbefore described as the land to be taken by the editorial tone of his paper.
Commander Fitts, assisted by Carl A. Soper of the executive committee and of the Santa Barbara post, ducted the hearing, summoned members of Carpinteria post and had had editor before them.
“I feel safe in saying,” the co-munder said, “that none of the members of the Carpinteria post who to part in this display of lawless violence will ever again be admitted membership in the Legion. I say the same thing of Mr. Clark. I men by their actions and Mr. Clay by his editorials showed they were not in sympathy with the ideals the Legion.”
His investigation convinced him Commander Fitts said that he present at the Legion meeting, which a delegation was appointed wait upon Clark, were aware that their action would result in violent Technically, he said, the whippin of Clark was not officially sanctioned as the meeting which appointed committee lacked one of having quorum.
“But the meeting was presided over by properly acceded Legion officers,” he explained, “and the intent of the meeting was apparent.”
Commander Fitts said all of men concerned in the whipping admitted their acts were indefensible and expressed deep regret for the currency. There were many members of the post, he said, who had not stifled the appointment of a comitee to see Clark.

SECTION 1. All of the herein described street work shall be done pursuant to the provisions of an act of the legislature of the State of California, entitled "An Act to provide for laying out, opening, extending, widening, straightening, or closing in whole or in part of any square, lane, alley, court or within municipalities and to confine acquire any and all land property necessary or convenient that purpose," approved March 1889, and the several acts amend thereof and supplementary thor.
