Drug Possession Case Scheduled for Superior Court By Orange County News Service The kind of criminal case that gives proponents of strict search and seizure restrictions on law enforcement agencies added fuel is scheduled to come before the Orange County Superior Court April 16. Scheduled to appear on this date is John Louis Aceguera, 21, of 629 Adams, Santa Ana, charged by the District Attorney's office with possession of marijuana. He was picked up by police in Santa Ana Feb. 20. Three judges have already voiced their displeasure with methods used by police in bringing the case to trial. Judge Howard Cameron of the Santa Ana-Orange Municipal Court tossed the case out because it lacked sufficient evidence. Officials of the District Attorney's office were able to get a change of venue. The case was introduced at the Anaheim-Fullerton Municipal Court on the grounds that new evidence was found. Judge Claude Owens described the charge as a dangerous precedent. He also voiced the opinion that officers had been "shopping" when they made the arrest. The judge felt the case should have gone back to Judge Cameron. District Attorney officials explained that they felt Judge Cameron had gotten a certain impression of the case as first presented. It was best to present the case as a new one and before a different judge. Judge Owens reviewed the new evidence and reluctantly ordered the case to the Superior Court. Judge Robert Gardner of the Superior Court, concurred with the opinion of Judge Cameron. He cited changes in testimony between the two proceedings. He described it as a case that is a he was obligated to allow the case to continue. "It will be an interesting case to follow in the court, an interesting case indeed," he remarked. The defendant this week appeared in court again, denied the charges, and requested a court trial April 16. According to testimony by police, the defendant was picked up at his place of employment on the tip of an informant, a man now serving a prison term. Police had no warrant for his arrest nor a search warrant. They were reportedly looking for an adding machine and shotgun that had been stolen from an industrial firm in Santa Ana. Police arrested the man on the burglary charge, noticed a mark on his arm and took him to police headquarters. A picture was reportedly taken of the man's arm. Still contending they were looking for the items taken in the burglary, they obtained the man's permission to search his home. Making a complete search of the home, the officers located a 28 sticks of marijuana. In the second court proceeding, the officers recalled that also ported missing in the burglary he been an electric shaver and a checker. Under questioning admitted having a vague description of the shaver and were sure what a fuse checker wore. These new items, however, justified their search of the box. A complaint charging the defendant with burglary was not filed. He was later charged with narcotic possession. Nothing was found in the home that linked him to the glary. Utt was commended by Coalson Morris, Orange County Republican Chairman, for his introduction in the House of Representatives of a bill requiring Federal Judges to take an oath of office. Referring to the recent Fresno convention of the California Democratic Council which advocated the repeal of loyalty oaths, Morris declared that "at a time when ultra-liberal elements now dominating the Democratic party are badgering the Legislature, it is gratifying to see our Congressman insisting that public officials stand up as Americans and openly declare their allegiance to the Constitution." "The legislative courage of Jimmie Utt is in striking contrast to the recent action of Assemblyman Dick Hanna who voted in the California Legislature to repeal the loyalty oath from state law." "Hanna's dialectic rationalization of his opposition to loyalty oaths becomes even more incredible in the light of the current expose by the House Un-American Activities Committee that a new Communist Party offensive is under way in California, designed to subvert every segment of our community." Morris went on. "As citizens we must insist that elected officials, like ourselves, must be ever alert to the infiltration of this insidious menace."
