LEGAL NOTICE
ORDINANCE NO. 907
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE 11 CHAPTER I OF THE ANAHEIM MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1.
That Article IX, Chapter I of the Anaheim Municipal Code be, and same is hereby amended to read as follows:
Section 9100 AUTHORITY
Pursuant to the "Subdivision Map Act" of the State of California, as it now exists or may hereafter be amended the provisions of this Chapter are supplemental to those of said Act, and shall apply to all subdivisions of land hereafter made when said land is entirely, or partially, within the limits of the City of Anaheim. The Anaheim City Planning Commission is hereby designated as the "Advisory Agency" referred to in said Act, and is charged with the duty of making investigations and ports of the design and improvements of proposed subdivisions and is hereby directed to recommend approval, conditional approval, or disapproval of tentative maps of subdivisions prepared and filed according to this Chapter and the said "Subdivision Map Act"; to recommend the kinds, nature and extent of improvements required to be installed in subdivisions.
Section 9100.1 CONFORMANCE TO PLANS
A subdivision plan shall conform to the official plan of streets. In the absence of an official plan of streets and highways, there shall be substantial conformance to the master plan. In the absence of a master plan, the street system in a proposed subdivision shall conform to the existing streets in the area existing the subdivision pattern unless the proposed street pattern is otherwise approved by the City.
Section 9100.2 STREETS AND HIGHWAYS
(a) Freeways, limited-access and unlimited-access State Highways shall conform to the standards of the Division of Highways, Department of Public Works, State of California, and where same are involved in any subdivision, they shall be subject to any additional standards or requirements of the City. Said standards of the Division of Highways shall be deemed to be the minimum.
(b) Major thoroughfares shall be not less than one-hundred (100) feet wide.
(c) Secondary thoroughfares shall be not less than eighty (80) feet wide.
(d) Local streets shall be not less than sixty (60) feet wide.
(e) Minor and cul-de-sac streets shall be not less than fifty-four (54) feet wide, nor more than five hundred (500) feet in length except where special conditions might justify a lesser width or greater length. The radius at the terminus the block and in approximately the location that would be occupied by an alley. If the easement boundary of a subdivision it shall be eight (8) feet in width.
(b) Overhead utilities should be located where possible through the interior of the block, but may be required along side lot lines where necessary to provide for street lighting or other utility purposes.
Section 9100.3 PARKING AREAS
(a) Special areas for off-street parking of motor vehicles offered for dedication or to be otherwise reserved for public use in connection with proposed business, industrial, unlimited multiple residential, or institutional property, shall be subject to determination by the City as to site location, shape and adequacy, and shall generally conform to the City Zoning Ordinance.
Section 9100.9 LOTS
(a) Lot areas shall be such will conform to the standards of development as defined in the Anaheim Municipal Code, Article 9, Chapter 2, entitled Zoning Regulations, or by other official plans adopted pursuant to law, provided the minimum area of lots shall be six-thousand (6,000) square feet except in the R-O, one family suburban zone, the minimum area shall be nine - thousand (9,000) square feet.
(b) Lots having no frontage on a public street may be causes for disapproval of a subdivision.
(c) The width of lots shall be such will conform to standards of development as defined in the Anaheim Municipal Code, Article 9, Chapter 2, entitled "Zoning Regulation" by other official plans adopted pursuant to law provided the minimum width of interior lots shall be sixty (60) feet, except that in the R-O Zone the minimum width of interior lots shall be seventy-five (75) feet. Reversed corner lots shall have a minimum width of sixty-seven and one-half (67.5) feet except that in the R-O Zone the minimum width shall be eighty-five (85) feet, and provided further that odd-shaped lots shall be subject to individual determination by the City.
(d) No lot shall be divided by a County, City or School District boundary line.
(e) The sidelines of lots shall be approximately at right angles to the street line on straight streets or to the tangent on curved streets.
(f) Double frontage lots should be avoided. All lots should be suitable for the purpose for which they are intended to be sold.
Section 9100.10 BLOCKS
The size of a map length and width of blocks shall be subject to individual determination and approval by the City.
(a) Blocks less than three hundred (300) feet in length, or less than two hundred (200) feet in width, or more than nine hundred ninety (990) feet in length may cause for disapproval.
(b) In blocks nine-hundred and ninety (990) feet long or over,
Survey Map shall be accompanied by a guarantee of title, except cases where land is registered under the Land Title Act Title) showing the names of persons, firms or corporations whose consent is necessary to title to road, street and other elements shown upon said map; also by a proper deed granting the City of Anaheim all easements so shown.
SECTION $100.2 DEDICATION AND IMPROVEMENTS.
(a) All streets, highways parcel(s) of land shown on the main map and intended for any use shall be offered for publication for public use.
(b) Street or portions of street may be offered for formal decoration where immediate ing and improvement is required but where it is necessary to insure that the City can accept dedication when said street is needed for the further development of the area or adjacent areas.
(c) The subdivider shall impair or agree to improve all lands located for streets, highways, etc., in addition to acceptance approval of the final map with the areas of abutting lots acres or less and such improvements may be required if the area abutting lots exceed one acre. Such improvement shall include such grading, facing sidewalks, curving culverts, bridges, storm drain sanitary sewers and such structures or improvements as are required by ordinance or decree by the City Council to be necessary for the general use of local owners in the subdivision local neighborhood traffic drainage needs.
(d) All improvements shall installed to grades approved by the City Engineer.
(e) Plans, profiles and specifications of proposed improvements shall be furnished to the City Engineer prior to the time of mititing the final map to him. Approved by the City Engineer and the Superintendent of Lil Power & Water before that shall be filed with the council. Such plans and proposals shall show full details of the proposed improvements which are according to the standards of the City of Anaheim.
(f) To assure that improvements will be completed and lien holders paid, a bond must be furnished guaranteeing factional performance and guaranteed payment for labor and material. The amount of such bond shall determined by the City Engineer and approved by the City Council as to amount and as to the city company, except in cases where appropriate by a whisper an inspector is required to present to inspect constructions of improvements. A minimum
shall be subject to any additional standards or requirements of the City. Said standards of the Division of Highways shall be deemed to be the minimum.
(b) Major thoroughfares shall not less than one-hundred (100) feet wide.
(c) Secondary thoroughfares shall not less than eighty (80) feet wide.
(d) Local streets shall not less than sixty (60) feet wide.
(e) Minor and cul-de-sac streets shall not less than fifty-four (54) feet wide, nor more than five hundred (500) feet in length except where special conditions might justify a lesser width or greater length. The radius at the terminus of the cul-de-sac shall not less than fifty (50) feet. Cul-de-sac minor streets shall be subject to individual determination by the City. Stub-streets or right-of-way may be required to the edge of the subdivision.
(f) Special local streets where railroads, parkways, grade separation, freeways and hills, or other dominant factors are involved shall be subject to determination by the City.
(g) Along major highways, limited-access highways or freeways a service roadway separated from the traffic line by a separation strip, when indicated by the master or official plan of the City or State will be required for access to abutting private property and local streets. All dimensions on such multiple roadway thoroughfares shall be as defined on the City official plan or State Division of Highways plan.
(h) Curved major highways shall have a center line radius of not less than one-thousand (1,000) feet.
(i) Curved secondary streets shall have a center line radius of not less than one hundred (100) feet. Less radial mills are used ifidence indicated the above requirements are not applicable.
(j) Street corners shall have a radius of not less than fifteen (15) feet an equivalent angle.
(k) Street intersections shall be as near right angles as is practicable. In no case should the angle be less than 45 degrees.
(l) Streets which are a continuation of streets in continuous territory shall be so aligned as to assure that their center lines shall coincide. In cases where straight continuations are not physically possible such outer line shall be continued by curves.
(m) In areas where no official plans exist, the layout of all improvements including roadways, curbs, parkways, dividing strips, sidewalks, sewer lines and water mains within the rights-of-way of all highways streets, alleys and utility easements shall be in accordance with standards established by the City Council, and where no such standards have been adopted such layouts shall be subjected to approval by the City Engineer, and the City Council.
Section 9106 GENERAL REQUIREMENTS
All sidewalks, curbs, gutters, water mains, culverts and drainage structures and other required pavements, sanitary sewer lines, improvements shall be installed at the cost of the subdivider and shall conform to grades and specifications established by the City of Anaheim.
Section 9106.4 SANITARY SEWER
Where a sewer line is constructed or laid within a street or road, the subdivider shall install a four (4) inch sewer service connection between the city and the subdivider.
Section 9106.1 COMMISSION ACTION AND RECORD
The Planning Commission shall consider tentative maps at its first regular meeting less than ten (10) days following the filing of said man's action or

Water sewer line is constructed or laid within a street or road, the subdivider shall install a four (4) inch sewer service connection to the property line of each lot within the subdivided area. All sanitary sewer lines, appurtenances and service connections shall be constructed or laid prior to paying to the grade established by the City Engineers and shall be of such size and design as required by the City and approved by the City Engineer.
Section 2100.5 WATER SUPPLY
Water shall be provided from the water system of the City of Anaheim. Water mains shall be constructed to serve each lot within the subdivided area and shall be of such size and design as required by the City and approved by the City and Power. All service connections shall be laid to the property line prior to paving.
Section 2100.6 ALLEYS
(a) Alleys twenty (20) feet wide shall be provided at the rear of all lots classified for and to be used for commercial or multiple family purposes. If adequate off-street parking areas to serve such property are securely reserved for such purpose and are shown upon the map and approved by the City in the manner herein provided, the requirements may be modified. Alleys elsewhere shall be optional with the City, but, if offered, they shall not less than twenty (20) feet wide and shall be subject to approval by the City both as to width and location. If the Official Plan indicates alleys which are not required by the general rule, then the alleys thus shown shall be required.
(b) Alleys at the rear of business, industrial or unlimited multi-residential property shall be subject to determination by the City as to design, location and width.
(c) Alleys shall be required at the rear of all property fronting directly upon any major highway.
(d) Where two alleys intercept or intersect, the corners shall be cut either on a ten (10) foot radius in which the lot boundaries are tangent, or on straight line connecting points on both lot lines ten (10) feet distant from the corner of the lot as the intersection of the alleys.
Section 2100.7 UTILITY EASEMENTS
(a) Where alleys are not required, utility easements ten (10) feet in width shall be provided generally through the interior of water mains, culverts and drainage structures and other required pavements, sanitary sewer lines, improvements shall be installed at the cost of the subdivider and shall conform to grades and specifications established by the City of Anaheim.
Section 2100.8 SANITARY SEWER
The Planning Commission should consider a tentative map at its first regular meetings held not less than ten (10) days following the filing of said map. Action or such tentative map in approving, conditionally approving, or disapprovving, shall be taken not later than thirty-five (35) days following the filing of such map. Within not to exceed five (5) days following the action by the Planning Commission upon any tentative map, the Secretary of Commission shall transmit a copy of the record pertaining to such action to the subdivider and the City Council. A copy of such official action on a tentative map shall also be permanently affixed to the official file copy of such map the records of the Planning Commission. Section 2100.16 COUNCIL ACTION AND REPORT.
The City Council shall report its action thereon to the subdivider and the City Planning Commission not later than ten (10) days following the first meeting of the City Council subsequent to the date on which the report of the City Planning Commission was received.
Section 2100.17 PREPARING FINAL MAP.
After approval of the tentative map by the City Council, the subdivider may cause a final map to be prepared in accordance with a completed survey and in substantial compliance with the approved tentative map, and in full compliance with "Subdivision Map Act" and this chapter. Section 2100.18 GUARANTEE OF PERFORMANCE.
The subdivider shall provide the necessary bonds to guarantee required improvements as provided in Section 2100.21 item (f). Section in Section 2100.21 item (f) Section in Section 2100.19 CITY ENGINEER'S ENDORSEMENT.
After receiving copies of the final map, the City Engineer shall examine the map as to sufficiency of affidavits and acknowledgements, correctness of survey data, mathematical data and computations and such other matters require checking to ensure compliance with the provisions of "Subdivision Map Act" and on this ordinance. If the final map is found to be in correct form and the matters shown thereon are sufficient, the City Engineer shall endorse his approval thereon and transmit it to the City Council. Section 2100.20 CERTIFICATE OF TITLE.
Each subdivision or Record of issue a receipt for the fee received, identifying same as related to the number of sheduled division for which such fee was tendered.
(f) A fee for checking final maps and improvements plans shall be charged at the rate of $3.00 per hour. This fee shall be paid prior to the completion of the Engineer's Certificate on the finapmap or final improvement plans which he later referred to.

(f) If the map complies with all of the items required in (b) above, the City Engineer shall approve that division provided that cusliving are installed along all public street frontage of property so divided consists of lots or parcels containing two acres or less and sanitary sewage facilities and connections shall made to each lot created, and lot sizes conform to the zoning ordinance of City of Anaheim and further provide in respect of design a tentative map approved by this Ordinance will adversely affect this subdivision affectthe Master Plan.
Section 2100.25-RECORD OF SURVEY MAP.
(a) A record of survey map must be filed for any division law for which a Subdivision Map Act." In such case there should not require bythe "Subdivision Map Act"be filed in office ofthe Councric Recorder,a recordofsurveymapconforminginrespecttodesign,a tentativemapapprovedbythisOrdinance.The same improvementsasrequiredbythisOrdinanceforsubdivisionshallberequiredfromthecaseofARecordofSurvey.Theconstructionofanyoftheimprovementsasrequiredinthisordinancemayasccribedinthisordinanceforafinalmapfiled.
(1) A certificate bytheengineorsurveyrowithgatherinhimtomakethesurveyandthistravelistrueandcomplete.shownThiscertificateshallalsatethatthemonumentsare,sufficienttoenabletravelforwillberetraced.
(2) A certificate orcertificationoftheCityEngineerrelatingtheexaminationofthemmayascuredinthisordinanceasprescribedbythisordinance.LIMITATIONONPROPERTYUSE.
Section 2100.26 Limitationpropertyuse
No building permit or other official authority for useofpreliminaryshallbeissuedforanyparceloflandisrecordedintheofficeoftheCountRecorderofOrangeCountyaspartofasubdivisionorassaypartofarecordofsurveyorwholeuchlotorparceloflandwhetherrecordedornothasresultedfromaplittingalotlorpossittheprohibitionsshallnotapplytoloansorpcarsoflandwhichwereunderseparateownershipontheeffectivedateofthisChapter.Section 2100.27-PENALTYFOVIOLATION

Section 2. REPEAL.
Ordinance No. 629 and all former ordinances or parts of ordinances conflicting or inconsistent with the provisions of this ordinance, including any physical condition created in violation of this ordinance, is permitted, continued or committed by such person firm or corporation and shall be punishable therefor as provided for in this Chapter, and any lot, street, alley or other feature made the subject of this Chapter maintained contrary to the provisions hereof shall constitute a public nuisance.
Section 3. ADOPTION.
The City Clerk shall cause this Ordinance to be published once in the Anaheim Eulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, and thirty (30) days from and after its final passage it shall take effect and be in full force.

CONSTRUCTION AND ALTERATION OF CERTAIN BUILDINGS, STRUCTURES AND IMPROVEMENTS, AND CERTAIN USES OF LAND; ESTABLISHING MINIMUM FLOOR AREAS OF BUILDINGS AND STRUCTURES IN CERTAIN AREAS OF THE CITY; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS THEREOF.

ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE, RELATING TO THE ESTATE LISHMENT OF ZONES IN THE CITY OF ANAHEIM AND THEREIN REGULATING THE USE OF LAND, HEIGHT OF BUILDINGS AND YARD SPACES, ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT, AMENDMENT AND ENFORCEMENT; PRESCRIBING PENALTIES FOR VIOLATION AND REPEALING ALL SECTIONS OR PARTS OF SECTIONS IN CONFLICT THEREWITH.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt a resolution declaring its intention to change the boundaries of the zone or zones hereafter mentioned and described and did fix a time and place for the holding of public hearings thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code and did hold two public hearings to consider such proposed change of zone or zones and receive evidence and reports from persons interested therein and did recommend a change or changes of zones as set forth in Resolution No. 70-Series 1953-54 of the City Planning Commission; and
WHEREAS, upon receipt of the report and recomendation of the City Planning Commission, the City Council did fix the 9th day of June, 1954, as the time, and the Council Chamber in the City Hall of the City Anaheim as the place, for a public hearing upon said proposed change of zone or zones and did give notice thereof in the manner and as provided in Article IX, Chapter 2 of the Anaheim Municipal Code, and
WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations and did thereupon adopt Resolution No. 4434 and determining that change or changes of zone should be made as set forth in said resolution.
NOW, THERFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
That Article IX, Chapter 2 of the Anaheim Municipal Code establishes a vote of the menus thereof: AYES; Councillum: Pearson, Fry, Wisser and Van Wagoner. NOES: Councillum: None. The map complies with all systems required in (b) above. Engineer shall approve the installation of a street frontage of the so divided when the proposed parcels containing two (2) or less and sanitary sewer and connections shall be each lot created, and all conform to the provisions ononing ordinance of the Anaheim, and further pro-tect that division will not affect the subdivision lands nor adversely affect the Master Plan.

In such case there shall be required by the "Subdivision in the office of the County," a record of survey map being in respect to design, to map approved in the provided by this ordinance, same improvements as re-buy this Ordinance for a subdivision for which a final map is certificate by the engineer responsible for giving the date of the sur-statting that the survey made by him or under his directing forth the owner who authorized make the survey and that key is true and complete as this certificate shall also that the monuments are, or sufficient to enable the to be retraced or certificates City Engineer relating to nomination in the case of a final prescribed by this ordinance.

Chapter 2 of the Anaheim Municipal Code "establishing zones in the City of Anaheim and therein regulating the area, height of buildings and yard space; adopting a man showing the boundaries of said zone; defining the terms used in said Article and Chapter; providing for amendment and enforcement thereof; prescribing penalties for violation and repealing all sections or parts of sections in conflict therewith", be, and the same is hereby amended by changing the boundaries of the zones set forth in said Article IX. Chapter 2 by adopting a sectional Zoning Map or Maps showing such change or changes as follows:
1. That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit:
That portion of the southwest quarter southeast quarter of Section 5. Browning Base and Meridian southwesterly of the southwest line of the 100-foot right-of-way conveyed to the Western Development Company by deed recorded June 12, 1876 in Book 44, Page 498 of Deeds. Records of Los Angeles County, California said property is further described as a triangular parcel bounded on the West by Gilbert Street, on the South by West La Palma Avenue and on the North by Manchester Avenue.
Now is Zone R-A. RESIDENTIAL AGRICULTURAL ZONE, and that be changed to and incorporated in M-1. LIGHT MANFACTURING ZONE, upon the following conditions:
1. That owner or owners of the property deed to the City of Anaheim a strip of land 20 feet in depth along West La Palma Avenue for future street widening purposes.
2. That a P-L. PARKING-LAND SCAPING ZONE, be established along West La Palma Avenue.
SECTION 2.

NOTICE IS HEREBY GIVEN that the City Council of the City Anaheim will hold a public hearing in the Council Chambers of the City Hall in the City of Anaheim on Tuesday July-13, 1954 at the hour of 8:00 o'clock P.M., to consider the recommendation of the City Planning Commission that SECTION 9200.14 A. USE. 2. PARKING.
SAID petition shall contain a request that the question to be submitted to the electors in the territory proposed by said petition to be annexed to said municipal corporation, shall be, whether such new territory shall be annexed to, incorporated in and made a part of its corporation in and made a part of its property therein, be after such annexation subject to taxation,
equally with the property within said municipal corporation to pay all of the bonded indebtedness of said municipal corporation, outstanding at the time of the filing of such petition or therefore authorized.
The reasons for the proposed petition are: That if said territory is annexed to the City of Anaheim, the owners thereof and persons living thereon will have the benefit of water furnished them by said municipality in the manner and at the rates furnished to consumers within said municipality. That said territory will have the benefit of police and fire protection, garbage and plant removal, street lighting, improved roadside and other such services. That the inhabitants of said territory will have the benefit of being governed by a governmental unit to which they will have close contact.

NOTICE IS HEREBY GIVEN that the City Council of the City Anaheim will hold a public hearing in the Council Chambers of the City Hall in the City of Anaheim on Tuesday July-13, 1954 at the hour of 8:00 o'clock P.M., to consider the recommendation of the City Planning Commission that SECTION 9200.14 A. Notice is further given that copies of said Sales and Use Tax Law being considered and to be considered for adoption are on file with the City Clerk of the City Of Anaheim and are open to public inspection.
The purpose for which said Code proposed is considered and is to be considered for adoption in reference is to incorporate it in make it a part of a proposed ordinance to be adopted by the City Council of the City Of Anaheim imposing a Sales and Use Tax of 1/2 of 1%, to be imposed on retailers for the privilege of selling tangible personal property at retail, and a jax imposed on the storage, use or other consumption of tangible personal property.
The subject matter of such Code proposed is adopted by reference in the name and address of the agency by which it has been promulgated, and the dates of publication thereof are as follows:
An Act imposing a tax for the privilege of selling tangible personal property and for the privilege of furnishing, preparing or serving tangible personal property; providing for permits to leavers; assisting collectors paying and disposing such tax; making an appropriation for the administration thereof; prescribing penalties for violation of the provisions thereof; and providing that act take effect immediately as enacted by the California State Legislature in 1933 and approved by the Governor July 31, 1933 (Statutes of 1933, Chapter 1020); and An Act imposing an excise tax on the storage, use or other consumption in the State Of California of tangible personal property; providing for the registration of retailers; providing for the levying, assessing collecting, paying and disposing such tax; making an appropriation for the administration thereof; prescribing penalties for violation of the provisions thereof; and providing that act take effect immediately as enacted by the California State Legislature in 1933 (Statutes of 1933, Chapter 1020).
