LEGAL NOTICE ORDINANCE NO. 594 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF ZONES IN THE CITY OF ANAHEIM AND THEREIN REGULATING THE ANAHEIM LAND HEIGHT OF BUILDINGS AND YARD SPACES; ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT, AMENDEMENT AND ENFORCEMENT; PRESCRIBING PENALTIES FOR VIOLATION AND REPEALING ALL SECIONS OR PARTS OF SECTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore fuly pass and adopt a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of public hearings therein in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct two public hearings to consider such proposed change of zone or zones and did receive evidence and reports from persons interested in them and did recommend a change or changes of zones as set forth in Resolution No. 595-54 of the City Planning Commission; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 12th day of January, 1954, as the time, and the Council Chambers in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed change or changes of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and receive response and reports and did therefore consider the recommendations of the City Planning Commission and did thereon adopt Resolution No. 2410 finding and determining that a change or changes of zone should be made as set forth in said resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Article IX, Chapter 2 of the Anaheim Municipal Code "establishing zones in the City of Anaheim and therein regulating the use of land, height of buildings and yard spaces; adopting a map showing the boundaries of said zone; defining the terms used in said Article IX, Chapter 2; providing for amendment and enforcement thereof; prescribing penalties for violation and repealing all sections or parts of section in conflict therewith" be, and the same is hereby, amended by changing the boundaries of the zones as set forth in said Article IX, Chapter 2 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: 1. That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The area bounded by the South side West Vermont Avenue, the West side of South Los Angeles Street, the North side of Ball Road and the East side of South Lemon Street, now is Zone R-A, RESIDENTIAL AGRICULTURAL ZONE, and that it be changed to and incorporated in the following zones, upon the conditions hereinafter set forth: 1. That the owners of the property deed to the City of Anaheim a strip of land 5.25 feet in depth along South Lemon Street for future widening of this street, and a strip of land 20 feet in depth along South Los Angeles Street and Ball Road for the future widening of these streets. 2. That a P-L, PARKING-LAND SCAPING ZONE, 60 feet in depth be created along West Vermont Avenue, South Los Angeles Street, Ball Road and South Vermont Avenue this P-L Zone to start at the new property line after allowance for street widening as above mentioned. 3. That the balance of the property be zoned C-L NEIGHBOORHOOD COMMERCIAL ZONE upon the following conditions; (a) That all plans and specifications for buildings to be erected on the property shall be subject to approval of an Architectural Committee consisting of the following: 1. One representative of the owners, their heirs or assists. 2. One representative of the appointed by the City Council. 3. An architect or designer designated by the owner or purchaser. This committee shall review the plans and specifications for architectural design, building locations, parking facilities, and other matters included within the deed restrictions and one set of exclusive streets. Is to be maintained for customer and service parking. (f) That no wall or fence shall enclose any portion of the customer parking area to the exclusion of adjacent parking areas. (g) That these restrictions shall expire on March 1, 1979. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare sectional zoning map added to the City Zoning Map and inserted in the Anaheim Municipal Code showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify the passage of this Ordinance and shall cause it to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper general circulation, printed, published and circulated in said city, and thirty (30) days from and after its final passage it shall take effect and be in full force. Distributed by King Features Syndicate. SYNOFSIS Like any young couple ardently in love, Joan Foster and Todd Hunter are eager to wed. But Todd has not yet been placed in his chosen profession of teaching, and the little money which Joan earns by writing, is not enough to maintain a home. CHAPTER TWO A SILENCE fell for a moment in the conversation between Joan and her mother. In it Joan heard a pair of robins filling the air with their twilight chirping. Lucky bird! Nothing for them to worry about but a few worms! "Which they can always find," she said aloud. "What on earth are you talking about?" Joan laughed and explained, "I guess it's still too cold to eat out here tonight, isn't it?" she asked, changing the subject. "Well, it's too cold for Gram, Mrs. Foster amiled reassuringly down on her daughter before going inside. Left alone, Joan's thoughts returned to the evening on the boat when she and Todd had planned for a June wedding. It had not seemed unreasonable then. They had agreed that he would surely have a job lined up by this time. But what, actually, had happened? Todd had spent the winter in study at Columbia University, commuting there daily to continue the work for his doctorate which had been interrupted in Switzerland by his illness. Columbia had accepted his foreign record for the first term, but he had learned he could not possibly complete the requirements there for his Ph.D. by the end of the semester in June. He would have to put in this sumcommended him on his background, which was declared "rich." But almost unanimously the colleges had said that there would be "no vacancy on their teaching staffs" or that they preferred "to engage some one with teaching experience" or that their German department was "shrinking rather than enlarging." They would be glad, however, to put his name in their active files in the event that something opened up later in the year. "How do you like that?" Todd had said heatedly to Joan. "Why are their German departments shrinking? Some of the most famous philosophers and thinkers and writers in the world have been Germans! I think that's crazy!" The Columbia agency had given him the answer. He'd have hated to spend the rest of his life on crutches or in a wheel chair, Puenmonia is, indeed, a friend of old people, as the doctors say." Joan nodded. "Weill, Mrs. Foster said, rising now, 'I must get back to the kitchen. I have a meat loaf in the oven.' "Oh, good. Todd loves a meat loaf. But can't Annie watch it?" "You forget. This isn't Annie's day." "Oh, yes. You have her only twice a week now, don't you? I do keep forgetting." "Yes, she was getting too old to work full time. And I had to economize. I planned a six-thirty dinner. Will Todd be here by then?" "By six, Mums. It's his early night. Can't I help you?" "No, thank you. You set the table before you went out this afternoon. By the way, did you find anything?" Joan shook her head. "I walked miles, too. I should have taken Todd's jalopy. No, I didn't find a thing except that room rhythms are almost as expensive as apartments. Everybody sees a chance to gouge, so they're gouging. Anyway I've decided that sharing a bath and a kitchen with people you don't know too well isn't an attractive prospect. I've about given up the idea of living in one room." "Well, something will work out. The future has a way of taking care of itself, I've discovered." And what, actually, had happened? He would be naifway to his posi though, by this coming September, and he had believed that with his Master's degree (which he had secured before going abroad) and almost two years of advanced credit toward the higher degree, he would have no trouble finding a position. Then, later on, perhaps in a year or two, he would finish his doctorate. But this would not be until he had saved up some money for more study and had acquired some experience in teaching. Having worked out the plan to his satisfaction, he had enrolled in February, quite confidently, in the agency conducted by Columbia to secure teaching jobs for their own students. He had also entered his name in an agency in Philadelphia and in one New York City, as well. Not content with that, he had obtained a list of colleges, junior colleges and preparatory schools between Maine and Virginia and as far west as Illinois, and had written a form letter to each of them, in which he had given a resume of his background and education, three character references, and information as to where the transcript of his college and foreign study could be secured. At the end of the letter he had asked if there would be an opening this coming fall for a teaching position in German and, if so, would the authorities kindly consider him? Joan had typed these form letters for him, all one hundred and fifty of them. Todd had had the courtesy of replies to more than four-fifths of his inquiries. Almost all of them than enlarging." They would be glad, however, to put his name in their active files in the event that something opened up later in the year. "How do you like that?" Todd had said heatedly to Joan. "Why are their German departments shrinking? Some of the most famous philosophers and thinkers and writers in the world have been Germans! I think that's crazy!" That interest in German had never been revived since the first World war. That Spanish had taken its place then and still held greater popularity. And, finally, that German scholars, from Europe, filled many openings in the institutions of higher learning now. The preparatory schools had not been any more encouraging. Their chief objection was to the fact that Todd planned to be married. "We have no accommodations for married teachers," they wrote. "Our teachers are required to live in the dormitories with the boys." Moreover, some had no German departments at all; some, like the colleges, expected no teaching vacancies; and a few were planning to do away with the language "since there is so little demand for it." In the end, only about six schools had so much as requested an interview. And Todd discovered during his appointments with the different deans of these six that one school was looking for a teacher, not for this coming fall, but for the following one. Another lost interest in him upon learning that he was a graduate of a high school rather than of a well-known preparatory school where he might have a student following. Two schools wrote him that another prospect, interviewed later, had been engaged, and two informed him that, after all, their own instructors had decided to remain. Some few letters were trickling in, but enough rejections had arrived to make Todd and Joan feel pretty grim and disheartened.
