Railroad shares as a group sparked the advance. They improved fractionally with a few issues showing much wider gains. Industrial shares, which recently ran up to their best levels since Oct. 22, 1929, were virtually unchanged. Market news was on dull side today. Investors appeared hesitant because of the recent strength in the industrials. The experts point out the list is way over-due for a correction. As a result, dealings throughout the session was at a slow pace. In the main industrial group, steel shares which have been moving smartly in recent sessions, tacked on fractional gains. Motor shares were about the same. Santa Fe was the bellwether in the carriers. I rose to a new high of 106½, up 2¼. It lost a good part of this gain just before the close. New highs were registered by Reynolds Metals, Southern aRilway Kern County Land, Bendix Aviation, Cerro de Pasco and Genera Dynamics. Hogan planned today to move "immediately" for reinstation of the vice conviction of oleo heir Minot F. (Mickey) Jelke. Hogan said he will seek permission to ask that the Court of Appeals throw out an appellate division ruling that the 24-year-old Jelke was deprived of a "fair and impartial trial" when the press and public were excluded. The appellate division said in a 3 to 2 decision Tuesday that Judge Francis L. Valente assumed powers not legally his when he barred newsmen from the lurid trial because "such extensive coverage of a case of this kind is catering to vulgar sensationalism, if not actual depravity."
