Dixie Segregationists Plan Battle To Preserve South’s Color Barrier ATLANTA — Dixie segregationists formed battlelines today in an effort to preserve the South's traditional color barriers despite the Supreme Court's historic decision that segregation in the public schools is unconstitutional. The high tribunal issued its long-awaited document Monday. It came after months of deliberating an issue regarded as the most vital affecting one region since cases from South Carolina, Kansas, Virginia and Delaware specifically. To Preserve South’s Color Barrier ATLANTA — Dixie segregationists formed battlelines today in an effort to preserve the South's traditional color barriers despite the Supreme Court's historic decision that segregation in the public schools is unconstitutional. The high tribunal issued its long-awaited document Monday. It came after months of deliberating an issue regarded as the most vital affecting one region since Abraham Lincoln's Emancipation Proclamation. The Supreme Court scheduled further arguments for next fall on vital issues connected with its unanimous decision and affected states were invited to submit additional briefs in the cases. Only after that will enforcement machinery be drafted. Thus, Negro and white student will not be going to school together in large areas of Dixie for perhaps many more years. The possibility of the long delay tempered reaction among white Southerners which ranged from appeals for calm to blunt warnings that no court decision can overthrow segregation in the South. Most Dixie congressional delegations were highly critical. Sen. James O. Eastland of Mississippi said "The South will not abide by this legislative decision by a political court." Unanimous Decision One of the biggest surprises of the decision was that it was unanimous. Gov. Herman Talmadge of Georgia, who hurled one of the sharpest barbs at the court's action, said he had expected at least a divided opinion. The Supreme Court invited attorneys general of the segregation states to submit briefs in the new autumn arguments, but there was a question whether they would accept. Georgia Attorney General Eugene Cook said he had contacted 17 attorneys general in affected states and had found none willing to submit to the decision without further litigation. States Take Action For the immediate future, some action by Southern state groups was in prospect. Alabama's special committee to recommend segrega-ops to the legislature will meet within a week, as will a similar Georgia group. The Louisiana legislature," only one in the South in session, will begin cases from South Carolina, Kansas, Virginia and Delaware, specifically affects 17 states with required segregation, and the District of Columbia. Further Court Arguments The court said that no decrees to implement its decision would be handed down until further arguments are held. Should school districts be allowed time for a gradual transition to a non-segregated status? 3. Should the Supreme Court appoint a special master to hear evidence to recommend specific terms of decrees to be ordered by the court? 4. Should the high court send the segregation cases back to the lower courts with instructions to frame decrees for implementing the non-segregation decision; if so, what procedures should the lower courts follow in arriving at specific terms of the decrees? State on the fringe of the Deep South expressed willingness to comply to the letter with the Supreme Court order, whatever it eventually may be. Kansas, Texas and Oklahoma were among them. Not so with the stronger segregation states like Georgia, South Carolina and Mississippi. Erwin Howard Spicer Dies at Beach Home NEWPORT BEACH (OCNS) — Erwin Howard Spicer, 70, of W. 208 Dahlia Ave., Corona Del Mar, died at his home Sunday morning after a long illness. Born in Junita, Nebraska, Mr. Spicer had lived in Corona Del Mar and the Newport area since 1940. He had been a resident of California for the past 40 years. Monday's decision, covering four NEWPORT BEACH (OCNS) — Erwin Howard Spicer, 70, of W. 208 Dahlia Ave., Corona Del Mar, died at his home Sunday morning after a long illness. Born in Junita, Nebraska, Mr. Spicer had lived in Corona Del Mar and the Newport area since 1940. He had been a resident of California for the past 40 years. He was an active member of Rotary and had retired from business and civic activities some time ago. Surviving Mr. Spicer are his widow Nettle Louisa; three daughters, Mrs. D. Hall of Corona Del Mar; Mrs. A. M. Flint of Houston, Texas; and Mrs. R. B. McKenna of Santa Ana; and a son Edgar H. Spicer of Corona Del Mar. Services are in charge of Baltz mortuary in Corona Del Mar and will be conducted at 11 am. Wednesday, Rev. Paul Babbitt of the Corona Del Mar Congregational church will officiate. Woman Ponders Divorce Problems LOS ANGELES (UP)—Superior Judge Philbrick McCoy today pondered the perplexing problem of Peggy Lou Wolfe Hirsch, 26, who doesn't know if she is the wife of a wealthy hotelman or a Texas oil operator. McCoy yesterday took under submission Mrs. Hirsch's plea for a California divorce from hotel owner Glynn Wolfe, whom she though she shed with a Mexican divorce. The attractive blonde seeks to determine the validity of her marriage to oilman William Hirsch. The married Hirsch in October, 1952, with her first husband, Wolfe, acting as best man. Both men now want to be her husband. Wolfe offered her half his hotel business if she returns to him, providing the legal tangle is resolved. Hirsch said he will continue to give her "everything the needs" if her divorce from Wolfe is legal. Since the Mexican divorce, Wolfe married actress Beverly Marsh and divorced her last February in the same Mexican separation center.
